By downloading, installing or using FuelPlan Pro (the "App"), you agree to be bound by these Terms of Use. FuelPlan Pro is operated by Clay Livingston Builder, trading as FuelPlan Pro, based in York, United Kingdom. If you do not agree to these terms, please do not use the App.

2. Description of Service

FuelPlan Pro is an AI-powered nutrition and fitness application that provides personalised weekly meal plans, workout schedules, shopping lists and progress tracking. The App is intended for general health and wellness purposes only and does not constitute medical advice.

3. Eligibility

You must be at least 13 years of age to use FuelPlan Pro. By using the App, you confirm that you meet this requirement. If you are under 18, you should use the App only with the involvement of a parent or guardian.

4. Subscriptions and Payments

• FuelPlan Pro is a subscription-based service. Access to premium features requires an active paid subscription.

• Subscriptions are billed through Apple App Store or Google Play Store at the rates displayed at the time of purchase.

• Founding member rates are locked in for life and will not increase for existing subscribers on that tier.

• A 7-day free trial is available for new subscribers. You will not be charged during the trial period. Cancellation before the trial ends will result in no charge.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

• You can manage and cancel your subscription at any time through your device's App Store or Google Play settings.

• We do not offer refunds for partial subscription periods except where required by applicable law.

5. Health and Medical Disclaimer

FuelPlan Pro is designed for general health and fitness purposes. It is not a substitute for professional medical advice, diagnosis or treatment. You should always consult a qualified healthcare provider before:

• Starting any new diet or nutrition programme

• Beginning any new exercise or fitness routine

• Making significant changes to your existing health regime

• Using the App if you have any existing medical conditions

FuelPlan Pro accepts no liability for any injury, illness or adverse health outcome resulting from use of the App.

6. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.

• You are responsible for all activity that occurs under your account.

• You must notify us immediately if you suspect unauthorised use of your account.

• We reserve the right to suspend or terminate accounts that violate these terms.

7. Acceptable Use

You agree not to use FuelPlan Pro to:

• Violate any applicable laws or regulations

• Attempt to gain unauthorised access to any part of the App or its infrastructure

• Reverse engineer, decompile or disassemble any part of the App

• Use the App for any commercial purpose without our written consent

• Upload or transmit any harmful, offensive or unlawful content

• Interfere with the proper functioning of the App

8. Intellectual Property

All content within FuelPlan Pro including but not limited to recipes, workout plans, text, graphics, logos, images and software is the property of Clay Livingston Builder trading as FuelPlan Pro, and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from any content within the App without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FuelPlan Pro and its owner shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of data, loss of revenue or personal injury, arising from your use of the App. Our total liability to you for any claim shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

10. Third-Party Services

FuelPlan Pro may integrate with or link to third-party services including Apple App Store, Google Play Store and payment processors. We are not responsible for the content, privacy practices or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.

11. Modifications to the Service

We reserve the right to modify, suspend or discontinue any part of FuelPlan Pro at any time with or without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by updating the date at the top of this document and, where appropriate, by sending a notification within the App. Your continued use of FuelPlan Pro after changes are posted constitutes your acceptance of the revised terms.

13. Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms or your use of FuelPlan Pro shall be subject to the exclusive jurisdiction of the courts of England and Wales.
